Terms of Use (EULA)

This End-User License Agreement ("EULA") is a legal agreement between you and Blazely ("Company", "we", "us", or "our") governing your use of the Blazely mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this Agreement.

1. Acknowledgment

You and the Company acknowledge that this EULA is concluded between you and the Company only, and not with Apple Inc., Google LLC, or any other app store provider. The Company, not the app store provider, is solely responsible for the App and the content thereof.

2. Medical and Health Disclaimer

IMPORTANT: NOT MEDICAL ADVICE. USE AT YOUR OWN RISK.

Blazely provides AI-generated content, including but not limited to workout routines, nutrition tracking, macronutrient goals, and fitness advice. This features are powered by Artificial Intelligence (AI) and are provided for informational and educational purposes only.

The Company is not a healthcare provider or a medical organization. The information provided by the App is not intended to diagnose, treat, cure, or prevent any disease, nor does it constitute medical advice. Always consult with a qualified healthcare professional before beginning any new diet, fitness program, or relying on AI-generated health metrics.

3. Disclaimer of Liability

You expressly agree that your athletic activities, dietary choices, and use of AI-generated workout and nutrition plans carry certain inherent and significant risks of property damage, bodily injury, or death, and that you voluntarily assume all known and unknown risks associated with these activities.

To the maximum extent permitted by applicable law, the Company completely disclaims any and all liability for:

Physical injury, strain, or medical condition resulting from executing workouts, exercises, or routines recommended by the App.
Adverse allergic reactions, malnutrition, weight gain/loss, or health complications resulting from following macronutrient ("macro") goals, meal data, or nutritional advice provided by our AI systems.
Inaccuracies, hallucinations, or unsafe recommendations generated by the artificial intelligence components of the App.

You agree to indemnify and hold harmless the Company, its directors, employees, and affiliates from any claim, demand, damages, or other losses arising out of your reliance on the App's content.

4. Scope of License

The Company grants you a non-transferable, non-exclusive license to use the App on any supported Apple-branded or Android-branded products that you own or control, and as permitted by the Usage Rules set forth in the respective App Store Terms of Service.

5. Maintenance and Support

The Company is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple, Google, and other app distributors have no obligation whatsoever to furnish any maintenance and support services with respect to the App.

6. Warranty

The App is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

7. Product Claims

You and the Company acknowledge that the Company, not Apple or Google, is responsible for addressing any claims of the end-user or any third party relating to the App or the end-user’s possession and/or use of that App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

8. Intellectual Property Rights

In the event of any third party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, the Company, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

9. User-Generated and AI-Generated Content

The App may allow you to input data and receive AI-generated outputs. You retain all rights to the data you input. The Company provides the AI capabilities as a tool but does not guarantee the accuracy, safety, or reliability of any AI-generated output.

10. Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against you as a third-party beneficiary thereof.
